I particularly enjoyed the email I received from nofx420fugazi (if this name doesn't make you piss yourself, then I don't know what would...) with the subject "FAGGOT."  The email said something along the lines of, "Expect a flood of email."  Surely, this is a young man who listens to what his bands have to say.

It's got to be hard to defend the behavior and attitude of the posters from HFStival.com.  Sending bulk email folders to folks with nothing to do with your issues, threatening viruses, trying to shut a fledgling site down.  It's like a short dude with a huge car; seem to be some adequacy issues pent up and raging through that board.

The No Electronic Theft Act does not apply to music and movies, that's why a year later the passed the Digital Millennium Copyright Act.

I post on HFStival.com, but not very regularly.  I agree that it is messed up for bigyawn to steal information from the hfstival site without giving credit to the author.  Also taking items from the "rumors" forum, and posting them as factual.
 
 I also find it messed up that users from HFStival.com are flooding bigyawns users with a flood of e-mail.  It isn't necessarily the users fault, and their inboxes shouldn't be flooded.
 
 However the bickering back and forth on the boards is quite comical to me.  So I will continue to watch all this unfold.

you know, i've noticed a lot of people on here calling hfstival.com people immature but i don't see you guys acting much more mature, i mean come on, posting pictures of me from 4 years ago is crazy and also illegal, those pictures are my property and i didn't give anyone permission to post them on a 930.com forum, so whoever did is breaking copyright law.

 First off, thanks for the 930 boarders, and bigyawn staffers standing up for us.
 
 Second, and I'll address this to thegrimace, you need to brush up on your copyright law chief, cause there is nothing, in any book, that will tell you message board material is copyright, and even if it was, I can tell you from my actual job, that what I did was called "fair use". I read information from more than one site (you think I'd just use HFestival.com?). I then wrote about what i learned on my website. I didn't quote anyone.
 
 I fully plan on giving a more formal repsonse on my site, and on yours, but I felt this forum offeres an opportunity to talk as adults. If you wanted me to add attirbution language, I prolly would have had you come to me as a normal human being. But since the hordes were unleashed, the chances of that are now zero. At some point in time, the numerous folks who tried valiantly to stand up for the rights of message boards everywhere will grow up, and decide "lick my balls" is not a proper response to an actual problem in their life. That being as it is, I am happy to talk to you, or anyone else from your site capable of forming a coherent thought.

The Entertainment industry was not prepared to let the court decide whether or not Music and Movies were covered by the No Electronic Theft Act, so they pushed the DMCA through congress before the courts could hear it.
 
 Either way, the material obtained in the HFSestival.com message boards are not protected by the NETA, and as a matter of fact I would recommend that you put a disclaimer that information contained in the message board should not be relied upon, for users to use at their own risk nor dies it reflect the opions of HFStival.com in any way shape or form.  That would be a much more prudent way to handle information contained in message boards, rather than attacking others for using the information in a manner they see fit.  I'm guessing that if you have a bioler plate license agreement that you make users agree to when they sign up to your boards, BigYawn was well within ther rights to use the information as they saw fit.
 
 I would also refrain from promoting Denial of Service Attacks if I were HFStival.com, especially in what could be considered competing businesses (assuming of course that one of the two web sites wants to make any money).

Wouldn't citing the email be source enough? And I assume HFS has interoffice email -- any email sent from one employee at HFS to another would be classified as interoffice...I'm sorry, I don't see what the big deal is here -- BigYawn clearly states what is posted is rumour and that the official line will be announced on Monday...It just seems a bit odd to get all upset about this...

Kosmo, they *posted* the admin username and password on their site.  I emailed their moderator about this, but am not sure he doesn't realize this is behavior that should be corrected.

no there wasn't permission.  The red wings banner has nothing to do with this arguement, however. Although it is morally wrong... he is stealing bandwidth, at least he is promoting the red wings in the process... which is something the red wings would not have a problem with, I'm sure of it.

Those pictures were not obtained from a post i made on the forum. They were illegal obtained from the cite itself without my permission which is illegal and that's why i'd like them to be removed from this cite.

Well, the admin password was simply a mention of a board name, though we have changed ours to be safe. Why is it our board only gets action for random acts of drama? I guess we have permanently offended a group of the population here in DC. At least most of them can't drive or drink, then I'd worry bout them suicide bombing one of our shows.

As an aside, for some reason the HFStival moderator was very reasonable with Markie (who was very reasonable as well) over on their site.  But all in all, that site makes ours look like a haven of reason and taste.

That's important information -- it certainly appeared that all the posters on the HFStival thread on this were involved in the emailing, board flooding, etc.  It's the full discussions on the HFS site that I've thought are just insane, and make me happy to be here.

We all go through some rough spots with haircuts.  I certainly can't throw stones.
 
 Either way, I'm sure you understand that posting on this board was a very easy way for a lot of people who have been receiving junk email to vent.
 
 I've said some spiteful things and I'm apologizing for them.  Hopefully you spend some more time on both BigYawn -- a great review site -- and the 930 forum.  HFS is no way to hear new music!

Yeah, check out the Soundtrack of our Lives review from a couple weeks ago, and today's on the Get Up Kids.  Nice to see the GUPs get props for growing...I've never understood why they get so slammed with all the other sh*t that's out there.

I'm not usually old-fashioned. But I'm not buying into the IPOD phenomenen. CD quality is still so much better. Also, the battery issue bothers me along with the fact that something better is coming around (See today's Post Business section).... And I'm not intentionally trying to change the topic   ;)

i think alot of the quality issue has to do with the rate you rip your mp3s. i never put on a cd at home, just go to itunes, have the computer hooked up to the stereo. can't tell the difference. besides, i listen to alot of lofi stuff anyway. i'm sure they will come out with something better soon, but will it work with osx?

Nice change of topic. I didnt think the ipod was a great idea either. But I got one for $100 and now if it broke, I would have to get a new one tomorrow. The battery issue is pretty rare. I dont have it. And the sound quality is great. Certainly better than my old panasonic portable CD player. Anything CD with shock protection is unlikely to sound better than a decent quality MP3.

 An open letter to the users/admins of bigyawn.net and 930.com,
 
 Admittedly, our actions this morning and afternoon were ridiculous, to say the very least. We were slightly bemused at the action Big Yawn took in reporting an entirely made up joke on our site as news, and further upset that they made no mention whatsoever of us as a source. It does a great disservice to the readers of Big Yawn to think that there's an shred of truth in that at all, and had it been cited as coming from us, it clearly would have been discredited out of hand, since after all, we're HFStival.com.
 
 That said, our actions just went way overboard. It was totally unjustified for, and we take all the blame. In our defense, we are HFstival.com, and as such, what were you expecting? We're clearly not a classy forum for DC-area music discussion like bigyawn.net or 930.com and we don't pretend to be. We're mostly uncultured and idiotic, and the mere fact we're on a board unofficially dedicated to an Infinity Radio sponsored festival show should speak to that.
 
 I would like to point out that the vast majority of HFStival.com posters had nothing to do with any of these actions whatsoever, and it is not a reflection of our administrator or his staff who, to the best of my knowledge, had no prior knowledge and gave no consent to these actions whatsoever. It was a bunch of idiots taking what they thought would be funny far, far overboard.
 
 So, we apoligize openly to bigyawn for our attack on them and apoligize as well to 930.com for this apparently affecting the traffic of their board as well. We also apoligize if this brought any black eye whatsoever to WHFS, which, while sucking hardcore, doesn't deserve to be linked to our horrid actions. Hopefully we can all just agree to leave each other alone, and we can all go back to some sense of normalcy; you folks with your discussion and us with our subhuman ape people throwing feces at each other.

 The beauty of the ipod is the integration with itunes. The easy ripping of CDs to Mp3s and to some the convenience of the istore.
 
 Although the napster system does sound great, it is not Mac compatible.
 
 I think advocates of either system would agree that its cool to have so much music easily accesible, either from the sofa, or the car, or on two feet.

i'll jump in the confession pool and say that some of my remarks were pretty snide... once in awhile my admin/moderater hat falls off.
 
 and before any conspirecy threories start getting propageted, as it often happens around here the forum registration system gets confused and stops registering new users.  it just so happens that it took another one its mini breaks today and i hadn't gotten around to see if new users were getting registered so it hasn't been fixed yet.
