don't know if true but I read he blew a .02 when the legal limit is .08.  How could he be charged if he is under legal limit?

Do not condone DUI but .02 is bullshit.

In NJ, there's no difference between a DUI and a DWI.  The legal limit is 0.01%

He parked his bike, posed for pics with fans, one of them gave him a shot, he drove off.

Also, it's a National Recreation Area, not a National Park. I've been up there in the summer and the roads are anything but deserted. Though i would guess they would be in the winter.
