Coroner: Elliott Smith death open question
« on: December 31, 2003, 12:24:00 pm »
Not sure if anyone saw this or not, but thought some of you might find it interesting.  Man, TWO stabs to the chest, if self-inflicted, is about the toughest thing I've ever heard in my life.

 From CNN.com-
LOS ANGELES, (Reuters) -- Los Angeles coroner's officials said Tuesday they could not determine whether the stab wounds that killed Oscar-nominated singer-songwriter Elliott Smith in October were self-inflicted.

An autopsy report appears to leave the nature of Smith's death, which was initially called a suicide by Los Angeles police, an open question.

The body of Smith -- who earned an Oscar nomination and widespread notice for his 1997 single "Miss Misery" from the film "Good Will Hunting" -- was found in October at his Los Angeles home by the musician's live-in girlfriend.

Coroner's spokesman David Campbell said Smith, 34, died from two "penetrating stab wounds" to the chest.

"The trauma that he sustained could have been inflicted by him or by another and the coroner has not been able to make a determination," Campbell said.

Campbell said toxicology tests found no illegal or controlled substances in Smith's system. The singer was apparently taking anti-depressants and medication for attention deficit disorder at the time of his death but was not abusing them, Campbell said.

He said the case would remain open and that coroner's officials would revisit their findings if additional information surfaced.

A spokesman for the Los Angeles Police Department said homicide detectives also would "look again" at Smith's death following the autopsy report. He said the case was initially reported to the LAPD as a suicide.

In CPR class we learned that the cracking noise you hear when performing CPR is the person's ribcage.  It would take a hell of a lot of force to penetrate the ribcage.  Smith's "suicide" has always seemed very suspicious.

The Final Moments of Elliott Smithâ??s Life
Autopsy reveals details of argument with girlfriend

 by Christine Pelisek

Moments before he died, singer Elliott Smith argued with his live-in girlfriend, who said she found him screaming outside the bathroom door of their Echo Park apartment, with an 8-inch kitchen knife stuck in his chest, according to an autopsy report.

The report, released this week by the L.A County Coronerâ??s Office, reveals new details about the investigation into the death of the 34-year-old musician, who died October 21 from two stab wounds at the Lemoyne Street home. Coronerâ??s officials said last week that they couldnâ??t determine whether Smith committed suicide or was the victim of homicide.

According to the January 6 report, Smithâ??s girlfriend, Jennifer Chiba, told police that she and Smith were arguing when she locked herself in the bathroom. She said she heard Smith scream, opened the bathroom door and found him standing with his back to her. When he turned around, she told police, she saw the kitchen knife in his chest. She said he was standing up, conscious and gasping for breath. She told police that she pulled the knife out of his chest and saw "two cuts" before he walked away and collapsed.

She called 911 at 12:18 p.m. and performed CPR and first aid with a dispatcherâ??s help until paramedics arrived. Smith died at County-USC Medical Center 78 minutes later.

Police officers arrived and questioned Chiba, who was seated at the kitchen table. Detectives reported that she pointed out a Post-it note that appeared to be a suicide note left on the table. The note said: "Iâ??m so sorry â?? love, Elliot God forgive me." Chiba told police that it was in Smithâ??s handwriting. The girlfriend could not be reached for comment.

LAPD Homicide Detective Jay King would not comment on the investigation and would say only that the case is still open.

Smithâ??s body had bruises on the right elbow and what appeared to be older marks on his right arm, left thigh and along his left shin. No track marks or cut marks were found on his wrists.

Deputy Medical Examiner Lisa Scheinin, in the autopsy report, wrote that Smith had a history of depression and that the wounds appeared to be consistent with suicide. However, she found that "several aspects of the circumstances (as are known at this time) are atypical of suicide and raise the possibility of homicide. These include the absence of hesitation wounds, stabbing through clothing, and the presence of small incised wounds on the right arm and left hand (possible defensive wounds)."

Coronerâ??s investigators also raised questions about the actions of Chiba, and why she removed the knife. "Detectives believe that this death is possibly suspicious, however, the circumstances are unclear at this time," according to the report.

The singer, who was born Steven Paul Smith, had been battling depression, drugs and alcohol for years, and had attempted suicide in 1997. Chiba told police that Smith often talked about committing suicide and had a history of addictions, including heroin, crack and alcohol. She said Smith engaged in self-mutilating behavior and would burn himself with cigarettes. Chiba told authorities that Smith had been drug-free for one year.

The coroner found no traces of illegal substances or alcohol in his system. The coroner did find prescribed levels of antidepressant and attention-deficit-hyperactivity-disorder medications in his system, including clonazepam, mirtazapine, atomozetine and amphetamine (the latter a byproduct of metabolizing the drugs).

Smith was born August 6, 1969, in Omaha, Nebraska, and began his career in Portland, Oregon, where he played in a punk rock band called Heatmiser. In 1994, he released his first album, Roman Candle, and later signed with DreamWorks, putting out XO in 1998 and Figure 8 in 2000. In 1998, Smith was nominated for an Oscar for best original song for "Miss Misery," from the soundtrack to Good Will Hunting. At the time of his death, Smith was working on his sixth album, known by its working title, A Basement on the Hill.

Now, here's the question: did he misspell his own name in a suicidal rage, or did someone else do it for him?

More on this from mtv.com (don't ask me what got me to the mtv site...)

Elliot Smith's Family to Girlfriend: Don't Speak for Us
 01.14.2004

When Elliott Smith's girlfriend claimed his family "knew the truth" that the late singer/songwriter's death in October was a suicide, she may have assumed too much.

A lawyer representing Smith's estate issued a statement on Wednesday (January 14) stating that no one should speak for Smith's family regarding his death, which continues to be investigated by the Los Angeles Police Department.

"Elliott's family has every confidence that the ongoing investigation will determine the actual circumstances of Elliott's death," the statement provided by attorney Conrad Rippy read. "Until such time as their investigation has concluded, however, and especially in light of the recently published coroner's report, neither Elliott's family nor anyone else can claim to know 'the truth' about Elliott's death, and any statement to the contrary mischaracterizes the family's position."

The statement is in response to an interview Smith's girlfriend Jennifer Chiba gave to MTV News on Friday, a day after the Smoking Gun (www.thesmokinggun.com) posted the entire coroner's report online (see "Elliott Smith's Girlfriend Insists No Involvement In Death"). The presence of cuts that appeared to be consistent with defensive wounds and the claim that Chiba had at one point "refused to speak with detectives," two occurrences that were not publicized until the report surfaced, may have presented Chiba in a new light to some.

Although she said she had not been questioned recently by police, Chiba nonetheless felt like a suspect, if only in the public's perception.

"His sister and his parents and everyone close to him knows the truth," Chiba said, "so I'm not worried about it."

The Smith family's statement closed by noting that the family will have no further comments on the investigation, and they would appreciate the public "respecting our privacy during this time of grief."

Rippy specifically represents Smith's father, who lives in Portland, Oregon; his mother, who lives in Denver; and his half-sister Ashley, a resident of Los Angeles.

Elliott Smith died October 21 from two penetrating stab wounds to the chest. A coroner's report completed December 31 could not determine whether the wounds were self-inflicted (see "Cause of Elliott Smith's Death Still Unclear, Coroner Says; No Illegal Drugs Found").
