We are not suing them...if you read the letter we are bringing our dispute with Cartel to their attention...and telling them that BY LAW Cartel (Atlanta) should not be allowed to perform under the moniker...now, they can choose to do what is right, or ignore it...hey, I'm aware it's a losing battle..it's been so far that way, we are just a small band from DC...if we were a big band with a record label behind us I bet you the other Cartel's name would've been taken off the website immediately...but such is life..$$$ runs it all and all we can hope for is people respecting the law without the need for active enforcement..utopia, I know..

i did read the letter and it warned of taking legal action. I am sure the owner of Sonar read your letter and chuckled.  
   
   thats not my opinion though, i think it stinks, and as long as you had the name first, you should be able to keep it.
 
   maybe have a battle of the bands!!! better band gets to keep the name (you should definitely be for this one!)

Fico, question for you, as I know nothing about your Cartel vs. Cartel Atlanta. Who has been in existance longer? My understanding, and I'm waiting for clarification on this, is that regarldess of when you got the trademark on the name, if Cartel Atlanta popped up and played a show the day before, they've got you beat. Whomever has been using the name longer, in the public, has the rights to the name. Again, I'm waiting for confirmation on this (my mother-in-law works in trademark law) but that's my understanding.

Federal law dominates trademarks these days, and while Cartel DC are relying MD Common Law, Fed law will eventually trump all.
 
 Fed Trademark law is either (1) First to Use or (2) First to Register with the PTO.  While registration is not required, it does offer you nationwide protection.
 
 Maryland also offers registered trademarks, and I would advise Cartel to register their trademark in MD if they decide not to use the PTO.  A registered trade mark is much more powerful then relying on common law.

EC was awesome,as was Emmylou,and though the sound was a bit out of control at first,things evened out well...and yes;you should have splurged on barn seating...even with the heat,being inside made it all more...real...
 especially the part about the liar
 that runs(?)this little country...

 Note:running into my ex and her new husband before the festivities was surreal/humorous as always;last time was at Iota for John Doe,but then what else would you expect at an Elvis show...buy the ticket,take the ride.
