If Stern ended up on XM I would seriously consider cancelling my account, unless his crap was a "premium" channel like the playboy channel...by the way, has anyone heard the playboy channel? I'm wondering how porn works on radio. [/b]
>>>It's really for people who just HAVE to masturbate in their car......you know.....when you just can't wait to get home or the traffic is bad and you're gonna be really late....

Why would you cancel your account?  You could just have XM block his station from your receiver and pretend he's not there. [/b]
I don't want any part of my monthly subscription going to that dick, regardless of wether I block it or not, he's still getting some of my cash. If it was put on a premium channel then that's a different story.

Then I'm sure it's a very popular channel because there's thousands of wankers driving cars around here...especially in N. VA.

That's insane.  That sounds as dumb as the folks who hate him but just CAN'T turn the dial.  "You mean there are *other* radio stations I could listen to?"

Did you get me again?!?    :p

i believe paige works at xm. . .bags and i work in energy law/policy.  nowhere near as exciting. [/b]
But, that does have me thinking.  You know these hugely increased fines they keep talking about?  (From $27K per incident to $500K, I think) -- the increased penalties bill has passed a House Committee, meaning it still has to get through both houses of Congress.  Not an easy feat.

THEN, it has to go through a regulatory process.  The FCC is an administrative agency, so any major rule or policy change would have to go through a public notice and comment period.  I know for energy, this process would take quite some time.  I don't know how the FCC would be able to unilaterally increase fines outside of this process.  This should be at least a year away....

 Bede, do you agree? [/b]
that is if they go through with a large rule change. . .i suppose the fcc could just use whatever regulatory language is already available to them, and just start increasing fines, without public comment.  that would put it on a fast track to the courts, i would think.

nevertheless, that sounds about right. . .congress would tell the fcc to implement the changes, it would go through a notice of proposed rulemaking, a final rule, and several additional changes after that.  then, it's on to the court of appeals, then supreme court.  in my energy experience, that could take at least 3 years.  course, that wouldn't stop the fcc from actually issuing fines, unless a stay was granted.

while i haven't read the legislation, it sounds like something that would pass overwhelmingly.  why?  because unlike most of us here, mom and dad don't want to see or hear "indecent" material, and simply aren't as open to the material.  nevermind the "if you don't like, don't watch it" belief, this is after janet, which everyone was watching.  mind you, i actually missed the oopsie, as i was reaching for another beer.

No, I didn't get you again. I just don't want any of my money going to that knobhead, and even if I never listen to his unfunny, bigotted remarks, part of my subscription is going in his pocket...unless he's on a premium channel, because you pay extra for those.

I think it would be easy to get a stay, as the increased fines did not go through a public administrative process.  And these are not de minimis penalty increases.

Mank, your ability to drop your XM subscription is the free market vehicle for communities to set standards.  They won't pay Stern if subscriptions drop precipitously due to his addition to the roster.  However, I'd bet they'd get a huge bump in subscriptions instead.

Either way, Stern needs to do something because one thing I can't listen to is his never ending self-absorption into this entire fiasco.

Seriously, if you're going to spend your entire show as your platform for bashing the FCC, then the FCC has already won.  All they wanted was your attention and to be able to say, "hey look, it's working.  Howard has stopped all of the restricted content, even if he does so at our expense."

He's no martry, he's a comedian.  And if he continues to regard himself so highly, I hope he moves to satellite radio sooner rather than later because I can't stand to hear his never ending diatribe of self-centeredness.  Get off you high horse and back on the comedy wagon....

Not true.  Clear Channel owns no more than 4.7% of XM.  I say "no more" because they hedged all their shares last year and may actually have zero at this point.

Clear Channel has no influence whatsoever on XM's programming.  They used to provide the content for some of the channels but that's been ended.  The only relationship now between the two companies is that XM leases some terrestrial repeaters from Clear Channel, and programs some talk hosts from Clear Channel's Premier Networks subsidiary.

But Stern is not going to satellite radio anytime soon.   He is worth far too much to infinity, certainly worth fighting the FCC, and his contract is impossible to break.
