some guy is protesting "pat downs" . . . and c
« on: August 01, 2006, 11:24:00 am »
this loser in florida is upset that he is patted down before entering a football game.  his safety and those around him means nothing, beyond being able to go on television and perhaps write a book about it.  he vows he'll fight it all the way to the supreme court.

if he wins, does that mean i can protest being patted down at concerts, including nine thirty, because it does violate my fourth amendment.

i don't go to 9:30 on a weekly basis or anything, but i've been to probably 40 shows over 10 years and i've never been patted down once.
it's nice to go somewhere and not be treated like a criminal.  the same can't be said for crossing back into the US from canada.. grrr

i've been patted down a few times, not always... but you'd rather not be patted down and run the risk of being knifed/shot/etc?  maybe i'm paranoid, but there are too many guns out there and even more idiots.  concert venues and sports facilities are private property, owners can set whatever requirements they want.  depending on the crowd, i've been creeped out by the lack of security at certain events & venues.

i'm not by any means a criminal procedure expert (talk to me in 72 hours), but you need to be careful in distinguishing the actions of a private business and those of the state

the line for suspicionless searches, like much 4A jurisprudence, is completely up in the air in our post-9/11 Roberts Court ... while courts previously barred suspicionless checkpoints whose primary purpose was to enforce criminal law (like drug interdiction checkpoints, rather than DUI checkpoints -- which ostensibly are for "public safety", not law enforcement), it appears as though "terrorism-related" checkpoints were approved by the Court pre-9/11 as a "special needs" checkpoint, and they have been upheld by circuit courts post-9/11

but some 930 club bouncer patting you down is very different than being stopped on the street and searched at a police checkpoint

i don't know.  maybe it's the shows i go to that don't really warrant a pat-down or something. i don't know.  i certainly don't worry about getting knifed or shot or anything at 9:30, even without getting patted down.  i'd probably worry about it more down here on the streets in richmond... but even then i don't really.

its not always knives or guns or bombs that are the reasons for patdowns.

some people (OAR fans) decide that they will be bringing their own beer into the show with them, and hide it in their short pockets.  while this isnt a safety issue, its about following the rules and the economical interests of the venue.

I understand as much as anyone how annoying this can be, and am constantly disappointed that the idiocy of others time and time again, inconveinces me or takes away my freedoms, but it is something that must be done.  the same goes for radar checkpoints on the highway....if you are not speeding, you dont mind them, but if you are never in an accident involving some asswad driving 100mph, you may just have those pesky patrolmen to thank.

in the end, i am only jealous that i do not have as much free time as this guy apparently has.

Dude, his complaint was the patting of every person *not* the patting of those who look/act/are suspicious.  I went to the ball game and missed the first inning though I was there an hour early because of the huge line for pat-downs.  That was the inning that the Orioles scored and set up for the win.  Do I feel safer with a pat-down?  No.  Of course not, most of the security at such things (and airports) do not really know what they are looking for, they just pat.  Look at how a police officer who is really looking for weapons does it, if you don't get crotched, you are not really being searched.  For a bomb, ask people to open their coats, that does a lot more than a pat-down.

go see the black crowes at nine thirty, and you'll see just what a pat down is.  i think they'll even break out the gloves and finger the 'ole hole this time around.
